Poultry is the main via of transmission of Salmonella for humans. However, there are no worldwide efficient control measures on primary production to guarantee elimination of this pathogen from raw poultry. Due to technological limitations, National Health Surveillance Agency exempted the obligation of surveys for Salmonella in raw chicken and established the Resolution RDC no. 13 of 200101/02. This resolution refers to the requirement of specific words on the label in order to instruct the consumer about the use, preparation and appropriate storage of these products. The objectives of this work were to evaluate the presence and quantification of Salmonella spp., and to assess the words on the labeling of frozen raw poultry on retail sale in the State of São Paulo between September/2004 and June/2006. Seventy-two lots totaling 360 sampling units of 26 different brands were evaluated. The presence of Salmonella was verified in 13.9% of the samples and the numbers varied from 0.03 to 2.3x103 MPN/g. These results emphasize the importance of enforcement of the RDC no. 13/01 to prevent the occurrence of the outbreaks associated to this pathogen. As for the labeling, 60% of the samples were in disagreement with the Resolution and 79%, with the Normative Instruction no. 22/05, law no 10.674/03 and Government Directive no 1004/98, confirming the need of the adequacy of the words on the label of these products to protect the health of consumers.
