The access to medications by the legal path signals the constitutional right to health and is more ample than the response capacity of the Sistema Único de Saúde (SUS). On the other hand, this practice can benefit individual, corporate, and pharmaceutical industry interests. The objective of this study was to identify the understanding and actions of the agents involved in the legal processes to access medications. A forum was held (162 participants from 35 municipalities) and a Technical Meeting (93 participants from 23 municipalities), with representatives from the Ministry of Health, Public State Ministry, from the Judicial Branch, from the Public State Defender, from the Regional Councils of Medicine and Pharmacy; Health Administrators, Law Attorneys, Law Prosecutor Attorneys, health care professionals, legal and press professionals, researchers and users. The speech from the Collective Subject of the representatives emphasized the supremacy of the industry’s power over prescribers, the media, and users, the distortions and economic impact of legal actions and the need for regulation of prescribers. On the other hand there was little emphasis in the discussions regarding the restrictions of access to goods foreseen constitutionally in the SUS and the mention of successful experiences in handling legal actions. The reactivity of the speeches appears to inhibit the elaboration of strategies to perfect the organization of the SUS and minimize its judicialization.
